Terms and Conditions for Waste Collection Highbury Services
These Terms and Conditions set out the basis on which Waste Collection Highbury provides waste and rubbish collection services to residential, commercial, and other customers. By placing a booking or using any of our services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
These terms form a legally binding agreement between you and Waste Collection Highbury. If you do not agree with any part of these terms, you must not use our services.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
"Company" means Waste Collection Highbury, the provider of waste collection services.
"Customer" or "you" means the individual, business, organisation, or other entity that requests or uses the services of the Company.
"Services" means all waste collection, removal, loading, transportation, and related services provided by the Company.
"Waste" means any rubbish, refuse, junk, or other materials to be removed by the Company, excluding prohibited or hazardous items as specified in these terms.
"Booking" means any order or request by the Customer for the Company to provide Services, whether made by telephone, email, online form, or in any other acceptable manner.
2. Scope of Services
The Company offers waste collection and removal services, including but not limited to household rubbish removal, commercial waste collection, bulky item collection, and general clearance services.
The exact scope of the Services for each Booking, including the type and estimated volume of waste, collection location, timing, and any specific requirements, will be agreed between the Company and the Customer at the time of booking.
The Company reserves the right to refuse to collect any Waste that is unsafe, prohibited by law, misdescribed, or materially different in nature or quantity from what was disclosed at the time of booking.
3. Booking Process
3.1 Making a Booking
Bookings can be made by telephone, email, or through any online booking system operated by the Company. When making a Booking, you must provide accurate and complete information, including:
The address for collection and any access instructions.
The type, approximate quantity, and nature of the Waste.
Preferred collection date and time window.
Your contact details and any relevant site contact details.
3.2 Booking Confirmation
A Booking is not considered confirmed until the Company has accepted it and provided you with confirmation by phone, email, or written message. The Company may, at its discretion, require a deposit or full payment in advance before confirming a Booking.
It is your responsibility to check the details of the Booking confirmation and notify the Company immediately of any errors or changes required.
3.3 Changes to Bookings
If you wish to change the time, date, address, or specification of the Services, you must contact the Company as soon as possible. Any changes are subject to availability and the Company’s agreement.
The Company reserves the right to apply additional charges where changes result in additional time, labour, travel, or disposal costs.
4. Access and Customer Responsibilities
You must ensure that the Company and its staff have safe and reasonable access to the collection point at the agreed time. This includes:
Providing accurate directions and access details.
Ensuring appropriate parking or loading facilities, where required.
Making sure someone is present to grant access where necessary.
You must ensure that the Waste is readily accessible, safely stacked, and does not present a health and safety risk to the Company’s staff or the public. The Company reserves the right to refuse to handle Waste that is unsafe or not reasonably accessible.
If the Company is unable to access the collection point, or if access is delayed due to circumstances within your control, waiting time charges or a failed collection fee may apply.
5. Waste Types and Prohibited Items
The Customer is responsible for accurately describing the Waste to be collected. The Company will only collect Waste that complies with applicable waste management regulations and these Terms and Conditions.
Prohibited or restricted Waste may include, without limitation:
Hazardous waste such as chemicals, solvents, asbestos, clinical or medical waste, gas cylinders, and certain electrical equipment.
Explosives, ammunition, or flammable substances.
Liquids in unsealed or unsafe containers.
Waste for which the Customer does not have the right to dispose.
The Company may request further information or documentation to determine whether certain Waste can be legally and safely collected. If prohibited or misdescribed Waste is presented, the Company may refuse all or part of the load and may charge for any wasted journey, time, or costs incurred.
6. Pricing and Payment Terms
6.1 Pricing
Prices for Services are based on factors such as the volume and weight of Waste, type of materials, labour required, access conditions, and disposal fees. Indicative prices may be given at the time of Booking, but final prices may be adjusted on site if the Waste differs materially from the original description.
Unless stated otherwise, all prices are quoted in pounds sterling and may be exclusive of VAT or other applicable charges, which will be added as required by law.
6.2 Payment Methods
Accepted payment methods may include debit or credit card, bank transfer, or cash, as advised by the Company at the time of Booking.
Payment terms will be confirmed in the Booking confirmation. The Company may require full payment or a deposit before carrying out the Services. For business Customers with approved accounts, alternative payment terms may be agreed in writing.
6.3 Late Payment
If payment is not received by the due date, the Company may charge interest on the overdue amount at the statutory rate permitted under UK law and may recover all reasonable costs incurred in pursuing payment.
The Company reserves the right to suspend or cancel any further Services to the Customer in the event of non-payment or repeated late payment.
7. Cancellations and Rescheduling
7.1 Customer Cancellations
If you wish to cancel your Booking, you must notify the Company as soon as possible by telephone or email.
Cancellations made more than 24 hours before the scheduled collection time will normally be accepted without charge, unless otherwise stated at the time of Booking.
Cancellations made within 24 hours of the scheduled collection time may incur a cancellation fee to cover administrative, staffing, and scheduling costs. If the team has already been dispatched, a call-out or failed collection fee may apply.
7.2 Rescheduling
The Company will make reasonable efforts to accommodate requests to reschedule a Booking. Rescheduling within 24 hours of the original collection time may be treated as a late cancellation and may incur a fee, at the Company’s discretion.
7.3 Company Cancellations
The Company reserves the right to cancel or postpone a Booking due to circumstances beyond its reasonable control, including but not limited to severe weather, vehicle breakdown, staff illness, safety concerns, or regulatory restrictions.
In such cases, the Company will endeavour to notify you as soon as possible and rearrange the Service for a mutually convenient time. The Company will not be liable for any loss or inconvenience arising from such cancellations or delays, other than refunding any prepayments for Services not provided.
8. Service Delivery and Performance
The Company aims to perform all Services with reasonable care and skill, in accordance with applicable waste management regulations and industry standards.
Collection times are provided as estimates or time windows and are not guaranteed. While the Company will make reasonable efforts to adhere to agreed time slots, delays may occur due to traffic, previous jobs, or unforeseen circumstances.
The Customer must inspect the work upon completion and raise any concerns or issues with the collection team or the Company within a reasonable time. If you believe that the Services have not been performed in accordance with these Terms and Conditions, you should contact the Company promptly to allow any appropriate investigation and remedy.
9. Transfer of Waste and Documentation
Once Waste has been safely loaded onto the Company’s vehicle and removed from your premises, ownership and responsibility for that Waste transfer to the Company, subject to compliance with waste regulations and any documentation requirements.
The Company will arrange for the lawful transportation, treatment, and disposal or recycling of collected Waste at licensed facilities. Where required by law, a waste transfer note or other documentation will be completed, and you agree to provide any necessary information for these records.
10. Liability and Limitations
10.1 General Liability
The Company will be liable for direct loss or damage to your property caused by its negligence or breach of these Terms and Conditions, subject to the limitations stated below.
10.2 Exclusions
The Company will not be liable for:
Any loss or damage arising from inaccurate or incomplete information provided by the Customer.
Any loss arising from failure to provide access or unsafe site conditions.
Any loss of profits, business, revenue, anticipated savings, or indirect or consequential loss of any kind.
Any damage to items or property that the Company’s staff are asked to move or handle in circumstances where such damage is reasonably foreseeable due to the condition, fragility, or nature of the items or access route.
10.3 Financial Limit
To the fullest extent permitted by law, the Company’s total aggregate liability to the Customer, whether in contract, tort, or otherwise, shall not exceed the total fees paid or payable by the Customer for the specific Booking giving rise to the claim.
Nothing in these Terms and Conditions shall limit or exclude the Company’s liability for death or personal injury caused by its negligence, fraud, or any other liability which cannot be excluded or limited under UK law.
11. Customer Indemnity
The Customer agrees to indemnify and hold the Company harmless from and against any claims, losses, damages, costs, or expenses arising from:
A breach by the Customer of these Terms and Conditions.
The provision of misdescribed, prohibited, or unlawful Waste.
Any claim that the Customer did not have the right to dispose of the Waste collected.
This indemnity shall apply except to the extent that any claim arises solely from the negligence or breach of the Company.
12. Compliance with Waste Regulations
The Company operates in accordance with applicable UK waste management and environmental regulations. The Customer agrees to cooperate with the Company to ensure compliance with such regulations, including providing accurate descriptions of Waste and any required documentation.
The Company may refuse to collect or may return any Waste where it reasonably believes that handling, transporting, or disposing of such Waste would be unlawful or unsafe.
13. Data Protection and Privacy
The Company may collect and process personal information about Customers in order to provide Services, manage Bookings, process payments, and comply with legal obligations.
The Company will handle personal data in accordance with applicable data protection laws in the United Kingdom. By using the Services, you consent to the collection and use of your information in accordance with these principles.
14. Complaints and Dispute Resolution
If you are dissatisfied with any aspect of the Services, you should contact the Company as soon as possible with details of your concern. The Company will investigate and aim to resolve complaints promptly and fairly.
If a dispute cannot be resolved through the Company’s internal process, both parties may consider mediation or other alternative dispute resolution methods before taking legal action, although this is not mandatory.
15. Changes to These Terms
The Company may amend these Terms and Conditions from time to time to reflect changes in the law, regulatory requirements, or the Company’s operations. Updated terms will be made available by the Company and will apply to all new Bookings made after the date of publication.
For existing Bookings, the version of the Terms and Conditions in force at the time of Booking will normally apply, unless changes are required by law or agreed with the Customer.
16. Assignment
The Company may assign or subcontract any of its rights or obligations under these Terms and Conditions, provided that this does not materially reduce the level of service to the Customer.
The Customer may not assign or transfer their rights or obligations under these Terms and Conditions without the prior written consent of the Company.
17. Severability
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms and Conditions, together with any written confirmation of Booking and any other documents expressly incorporated by reference, constitute the entire agreement between the Company and the Customer relating to the Services. They supersede any prior agreements, understandings, or representations, whether oral or written.
19. Governing Law and Jurisdiction
These Terms and Conditions and any dispute or claim arising out of or in connection with them, or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of Services by Waste Collection Highbury.
